NMPA Unveils World's First BCI-EEG Dataset Standard; CMDE Opens AI Multi-Disease Device Guidance for Comment
On September 14, 2026, China's NMPA approved YY/T 2029—2026, the world's first industry standard for EEG datasets used by AI algorithms in brain-computer interface (BCI) medical devices, effective September 1, 2027. Two days later, CMDE opened for public comment a new clinical-evaluation guidance for AI-based multi-disease assisted-decision devices, alongside the 2026 revision of the overarching AI medical device registration guidance. The moves signal China's push to set global rules for AI-enabled and BCI medical devices.
01World's First BCI-EEG Dataset Standard Approved
NMPA Announcement No. 79 (2026) approves YY/T 2029—2026, the third BCI medical device standard issued by China and the first worldwide to specify quality requirements and evaluation methods for EEG datasets processed by artificial intelligence algorithms. The standard covers the full pipeline—signal acquisition, transmission, preprocessing, annotation, storage, and access control—providing a unified 'quality ruler' that addresses long-standing inconsistencies in dataset construction among BCI developers. It takes effect on September 1, 2027. NMPA used an expedited standard-setting procedure to support major BCI innovation, positioning China as a rule-setter rather than a follower in this frontier sector.
02CMDE Seeks Comments on AI Multi-Disease and Revised AI Registration Guidance
On September 16, 2026, CMDE released for public comment the 'Clinical Evaluation Registration Review Guidance for AI-Based Multi-Disease Assisted-Decision Medical Devices,' complementing the 'AI Medical Device Registration Review Guidance (2026 Revision)' published on September 14 with a feedback deadline of October 12, 2026. The 2026 revision—the first major update since the 2022 edition—introduces dedicated chapters for large language models, medical agents, multimodal image synthesis, and continuous-learning algorithms, and sharpens requirements for algorithm updates and data quality control. It classifies AI devices into assisted-decision (higher risk, generally requiring clinical trials) and non-assisted-decision categories, and explicitly requires imported AI devices to address differences in ethnicity, epidemiology, and clinical practice between China and their home markets.
03Market Momentum and Implications for Foreign Manufacturers
China's BCI sector is accelerating rapidly: the 2026 market size is projected at 46 billion yuan (up from 38 billion in 2025), and year-to-date primary-market funding reached 9.474 billion yuan across 99 deals—already nearly four times the 2.401 billion yuan raised in all of 2025. BCI was named a 'future industry' in the 2026 Government Work Report, and Zhejiang province alone targets over 5 billion yuan in BCI revenue by 2027. For overseas manufacturers, the new standards and guidance mean earlier regulatory certainty: companies developing AI-enabled diagnostic software or BCI rehabilitation devices now have defined classification pathways, dataset quality benchmarks, and clinical-evaluation expectations. Importers should align their datasets with YY/T 2029—2026 well before the 2027 effective date and prepare ethnicity- and epidemiology-specific clinical evidence for AI-assisted-decision products.
